Troy man pleads guilty to organized crime theft ring, avoids prison due to medical condition

PITTSFIELD, Mass. – Angel Nunes, 57, formerly of Troy, New York, pleaded guilty Tuesday to 15 charges related to his involvement in an organized burglary ring that targeted Berkshire Bank locations last year.

Nunez admitted to attempting to make fraudulent withdrawals during three visits to Berkshire Bank branches on June 23, June 26 and July 10, 2023. He pleaded guilty in Berkshire Superior Court, where the Honorable John Agostini presided over the case.

Berkshire County prosecutors had sought a two-year sentence in the correctional facility, while Nunez’s defense team had sought house arrest, citing his poor health. Judge Agostini sentenced Nunes to two years of continuous probation with the condition that he not commit any additional crimes.

Prosecutors said Nunez’s health was a key factor in the sentencing, as the correctional facility lacks facilities to provide the necessary level of care.

Nunez’s guilty plea and unique sentence highlight the challenges the criminal justice system faces in trying to balance punishment with medical and humanitarian considerations.
