Elena’s husband is charged with attempted murder

On Oct. 31, a 41-year-old Helena man was charged with attempted first degree murder after allegedly wielding two axes and threatening to decapitate the victim.

Calvin Merle Weigel was charged in Lewis and Clark County Circuit Court with attempted murder, three counts of assault with a weapon, assault on a partner or family member, third offense and misdemeanor violation of a no-contact order.

According to court documents, officers responded to the 600 block of South California Street on Oct. 31 for a report of a fight between a man and a woman.

The defendant threatened the applicant with an ax, the documents say. The applicant told the police that she was in the apartment when Weigel came home in an intoxicated state.

The documents state that the defendant told the complainant and another person that they were going to be evicted and if anyone was still there on Monday, they would be killed.

Weigel followed them into the kitchen with two axes, where he swung them a few feet away, court records said.

According to the documents, one of the complainants was in an intimate relationship with the defendant, and after they left the kitchen, Weigel knocked one of them over a chair.

A third person who was a witness intervened to protect the Weigel woman, who allegedly knocked over a chair and was threatened by the defendant.

Weigel picked up an ax and told the witness he was going to cut his head off, while “aggressively” approaching him, the lawsuit alleges.

The witness put his hands up to defend himself, and officers noticed a laceration on his hand. The witness restrained the defendant and pulled the ax out of his hands.

Court reports state that the defendant grabbed a second ax and swung it at him.

As of Nov. 1, Weigel was being held at the Lewis and Clark County Detention Center.
