MOFCOM regrets EU’s WTO complaint on SEP disputes, reaffirms commitment to protecting legal rights

China’s Ministry of Commerce (MOFCOM) on Monday expressed regret over the European Union’s decision to refer China’s litigation of standard essential patent (SEP) licensing disputes to the World Trade Organization (WTO) dispute settlement mechanism and reaffirmed its commitment to firmly defend its legal rights and interests in this case.

The comments were made by a representative of the Ministry of Communications’ contract and legal department in response to media inquiries about what is reported to be the EU’s latest move.

In a statement published on the ministry’s official website, it received a request from the EU for consultations on the matter earlier on Monday.

The official emphasized that China has consistently adhered to the WTO rules and its accession obligations, and is constantly strengthening the legal framework and enforcement of intellectual property rights protection, while its progress is widely recognized.

“The channels for dialogue between China and the EU on intellectual property issues remain open,” said a representative of the ministry.

“China regrets the EU’s decision to initiate legal proceedings,” the official added, confirming that China will resolve the following issues in strict accordance with WTO rules and resolutely defend its legitimate rights and interests.
