A First Information Report (FIR) was registered against the accused under relevant sections of the Maharashtra Regional and Town Planning (MRTP) Act, 1966 following a complaint filed by the Brihanmumbai Municipal Corporation (BMC), officials said.

“The BMC received a complaint from one person regarding illegal alterations in the Ocean 360 building located on Banganga Road,” said a police officer from Malabar Hill police station. “Responding to the appeal, BMC teams visited the building. During the adoption of the plan, they found several changes from what was approved by the public body.”

According to police, BMC teams found illegal constructions in the podium area of the building and alterations in some flats such as protruding windows. Some apartments have also expanded their area by including part of the elevator lobby.

The BMC has given time to the developer to correct the illegal changes, a police officer said. “However, when nothing was done, we were approached by Dhiraj Karande, Junior Engineer, Division D. A case has been registered against directors of Fair Deal Constructions, Fayyazzudhin Shaikh and Waseem Shaikh, who have offices in Khar. The architect was also recorded.”

The police, who have received photographs of the alleged alterations from the BMC, will now record the statements of the alleged accused, the officer added.
