Woman sues JetBlue after breaking tooth on in-flight ice cream sandwich

A traveler filed a complaint against JetBlue this week after she said she was served “frozen” ice cream that allegedly broke her tooth during a flight.

According to documents obtained by PEOPLE, passenger Kiara Quinones claims JetBlue served her a Nightingale brand strawberry ice cream sandwich before she suffered an oral injury.

Quinones filed a federal complaint against JetBlue on Tuesday, Oct. 22, in New York’s Eastern District Court, alleging that the airline served her “food at a temperature below acceptable or safe for consumption” and failed to “warn (her)” of the dangerously low the temperature and firmness of the ice cream sandwich she was served.”

An attorney for Quinones and JetBlue did not immediately respond to PEOPLE’s request for comment on Sunday, Oct. 27.

The “size” ice cream sandwich was given to Quinones on Flight 1907 from John F. Kennedy International Airport in New York to Charles de Gaulle Airport in Paris on August 20, when she was traveling with her fiance.

She claims the dessert was “frozen solid” when it was served to her, causing her to “suffer severe injuries, including a fractured root of tooth number 10” — also known as the upper left lateral incisor.

The passenger claimed that the injury to her tooth required an emergency tooth extraction, subsequent implants and additional care, as the lawsuit alleges the airline’s “negligent actions” resulted in “pain, suffering and emotional distress.”

“As a direct and proximate result of the actions of the Defendant, its agents and/or employees as described above, the Plaintiff has suffered serious and permanent bodily injury, pain, suffering and mental anguish, and incurred medical and treatment expenses, all of which are continuing.” , – the complaint states.

Quinones is now seeking a judgment against the airline “in an amount to be determined by the jury at the trial of this case,” plus interest and other “remedies” that the court “may deem just and proper,” according to the order. complaint.

The latest temperature-related lawsuit comes more than three months after another JetBlue passenger filed a lawsuit alleging she suffered severe burns after a “dangerously hot” cup of tea was spilled on her during a flight from Orlando to Hartford, Connecticut in May.

According to the lawsuit, obtained by PEOPLE, the crew member “spilled a dangerously hot cup of tea on” passenger Tahyana Lewis — with injuries including her upper chest, chest, legs, left buttock and right arm, as well as “disfigurement and scars”.

The incident also caused her “mental pain, anxiety and post-traumatic stress,” according to the lawsuit.

A spokesperson for the airline did not respond to PEOPLE’s request for comment at the time.

In that lawsuit, Lewis is seeking more than $1.5 million in damages, saying some of her injuries will allegedly be “permanent in nature and/or permanently disabling.”
