Man charged after person killed in Buckhannon DUI crash

BUCKHANNON, Va. (WBOY) — A man accused of driving under the influence has been charged after he was involved in a crash that left one person dead in Upshur County last weekend.

On Nov. 2, Buckhannon Police Department officers were dispatched to the scene of a two-vehicle accident on W.Va. Rt. 33 across from Pizza Hut, on a criminal trespass complaint.

When officers arrived, paramedics already on the scene said the “unidentified driver of the second vehicle was deceased” and the black truck “was empty.”

A witness to the incident told police that the man, later identified as 33-year-old Joshua Foster, “took off behind Pizza Hut.”

Foster later approached officers from the area and said “he was the truck driver” and “admitted to drinking before the trip to ‘clear his head,'” officers said.

After Foster spoke with officers, he “began to stumble and was helped to call 911,” and officers “informed him that he was under arrest on suspicion of DUI” and read him his Miranda rights, according to the complaint.

After Foster was given his Miranda statement, he “admitted to drinking before driving,” and Foster “did indeed blow a .242 on the preliminary breath test,” officers said.

Foster was charged with intoxication manslaughter. He is being held at Tygart Valley Regional Jail on $500,000 cash only bond.

The victim is not named in the complaint.
