Prosecutors have denied accusations by Sean “Diddy” Combs’ defense team that they released surveillance footage showing Diddy allegedly assaulting his ex-girlfriend Cassie in 2016. Diddy’s lawyers previously said it would be a series of arguments in favor of their client, who is in combat. this month, the government’s alleged leak of that hotel video to CNN jeopardized his right to a fair trial.

Prosecutors responded in a newly filed motion Wednesday, Oct. 30, denying the claim and accusing Diddy’s team of trying to “cover up the incriminating piece of evidence,” Billboard reports.

As for the prosecution, they say the video was never in their possession at the time of CNN’s May broadcast, which showed “shocking” footage of the incident. “Without any factual basis, the leak motion is intended to suppress probative evidence,” the prosecutor said in a statement, noting that “the video was not in the Government’s possession at the time of CNN’s publication, and the Government has never, at any time, didn’t get the video because of the grand jury process.”

Understandably, Diddy’s lawyers previously argued that the leak of the video “resulted in prejudicial, highly prejudicial publicity” that could potentially prejudice jurors, arguing that it threatened to undermine Diddy’s right to a fair trial. They also called for an investigation into the alleged leak.
