Through these charges, the plaintiff filed a complaint to Texas Western District, claiming that the defendant violated the position of ATDS 47 USC § 227 (B) (1) (A) (III) and 47 USC § 227 (B) (1) (B) when the defendant Called the plaintiff’s residential phone with an artificial or pre -recorded voice. The plaintiff seeks to present the following two classes:

TCPA class. All persons in the United States, who: (1) from the last 4 years before the representation (2) of the defendant called and/or any entity who makes calls on behalf of the defendant (3) whose telephone numbers were registered in the Federal Register , do not call for more than 30 days.

Texas subclass. All persons in Texas who: (1) The last 4 years before the presentation (2) the defendant called any essence that makes calls on behalf of the defendant (3) whose telephone numbers were registered in the Federal Register for no more than 30 days in time .
