The Consumer Commission of the District Ernakulam rejects a complaint on the Indian foreign bank for delayed discharge on lottery prize money

WITH District Consumer Disputes of the Commission on Reimbursement of Erkakoles, Kerala He rejected the complaint against the Indian foreign bank, filed in accordance with Section 35 of the Consumer Protection Law in 2019. Benry Sri DBbin (President), Shri Ramachandran (member) and smt.sreevidhia.tn (member) recognized that the complaint could be rejected because the evidence indicates that the amount was credited to the complainant’s account was delayed .

Background

The complainant claimed to win 3version Bumper-lush prize Bumper 2020, for which he had to pay a prize money in the amount of Rs. 10, 00,000. Noting that the bank transferred lottery tickets and allied documents to the office in the lottery later, the complainant claimed that he had been denied prize money. According to him, in the submission of a lottery ticket and documents of the bank took place 151 days. Further stating that according to the rule, tickets should be transferred to the Lottery Department for 30 days to pay the prize money to the complainant, it was argued that the bank deficits in its services to send a ticket and documents late, therefore, denying him the prize money.

The complainant stated that he had experienced severe mental agony, stress and other difficulties, and was subsequently accepted in the hospital due to some heart problems. Subsequently, the complaints were sent to the Bank asking for compensation of 30.00 000 rubles, and numerous complaints of the director of Lothery Kerral, Tiruvanantapram were filed.

Later, the complainant appealed to a commission that requires RS compensation. 5,00 000 form a bank for being responsible for the shortage of service.

Submission of the opposite side

The Bank claimed that the complaint could not be executed because it was not a case associated with the consumer and the services provided to him. It was further stated that the documents could not be transferred to the main branch of the opposite side of Trivandrum due to the recorded blocking of the Covid-19. The lawyer of the opposite party stated that the complainant was interested in the status of the lottery collection on 25.08.2020 and after checking the main branch of Trivandrum, the Bank asked for some additional documents provided by the complainant on 9.03.2020. These documents were handed over to the 4/9/2020 bank. 15/3/2021, after processing of documents, prize money Rs. 6.30,000 were credited to the complainant’s bank account. The opposite party also argued that the delay in submission and processing of documents also took place due to triple closure in the city of Tiruvanontapator. Conclusions of the Commission

The evidence commission noted that the complainant received 10,000 rubles as compensation for the delay of the part of the opposite party. Moreover, the approval and payment of money entitled to the prize from the date of receipt of the necessary documents. The commission noted that the actual reason for the delay in payment of prize money was the submission of insufficient documents. It was found that since the prize money was paid immediately after 30 days after the necessary documents were submitted, there was no shortage of services on the opposite party.

In carrying out these observations, the commission rejected the complaint without expenses.
