Baldoni, Wayfarer, Heath, Sarowitz, Nathan, TAG, Abel, RWA Communications, Wallace and Street Relations sued against The New York Times December 31.

In the lawsuit, obtained by E! News, The New York Times is accused of defamation, false invasion of privacy, promissory note fraud and breach of actual contract, alleging a retaliatory smear campaign the plaintiffs allegedly waged against Lively after she raised concerns about alleged on-set misconduct.

Claiming the report was “false” and based on Lively’s CRD complaint, the plaintiffs denied the allegations and claimed messages given in the article and complaints were taken out of context.

“Despite the fact that he “reviewed these documents together with other documents (,)”. times “relied almost entirely on Lively’s unverified and self-serving account,” the lawsuit says, “rejecting it almost verbatim, while ignoring a large body of evidence that contradicted her claims and exposed her true motives.”

They also claim that “it was Lively, not the plaintiffs, who engaged in a calculated smear campaign.” She denies it.

The New York Times said it plans to “vigorously defend itself against the lawsuit.”
