(Grey News) – Two parents in Texas are suing a daycare after their 2-year-old daughter allegedly fell into a drain and was trapped for nearly an hour before anyone noticed.

According to the lawsuit, the girl was a student at Lighthouse Kindergarten in Prosper, a suburb of Dallas. This is reported by WFAA.

On November 1, the girl was on the playground with other children when she fell into a hole.

The cap, which read “Do Not Inject Deadly Poison Gas,” had either flipped over or been replaced, trapping it inside, the lawsuit said.

According to the lawsuitthe teacher or other daycare worker dismissed the girl from the classroom at 4:01 p.m. because she was not there and no one was looking to make sure she was somewhere else.

The lawsuit alleges that daycare workers did not immediately call 911 after noticing the child was missing.

Finally, almost an hour later, she was found covered in mud and showing signs of suffering.

“She was blue and pale. Pissing from dirty water,” the suit reads.

The girl’s parents are demanding accountability and answers, claiming the kindergarten refused to provide them with surveillance footage of the incident.
