RNC asks Supreme Court to intervene in Pennsylvania vote-by-mail case

The Republican National Committee (RNC) on Monday asked the Supreme Court to wade into Pennsylvania’s vote-by-mail case, arguing that the state Supreme Court “misread” the state’s election code.

Supreme Court of the State of Pennsylvania decided last week that voters can still vote early this November if mail-in ballots are rejected for failing to follow procedural guidelines, such as the absence of mandatory secret envelopes that voters must sign and date.

The RNC argued that the court misread a state law that says an “advance ballot does not count” if the mail-in ballot was received by county election officials on time.

“When the Legislature says that certain ballots can never be counted, a state court cannot write down that express command always,” the RNC’s legal team wrote in their application. “The General Assembly could not have been clearer here.”

Monday’s request went to Supreme Court Justice Samuel Alito, who hears emergency appeals from Pennsylvania. Alito ordered other parties to respond to the RNC by Wednesday.

The request comes after more than 1.4 million mailed ballots were returned this year. This is reported by The Hill. It also comes just over a week before the 2024 presidential election, where Pennsylvania is considered a critical swing state.

The RNC asked the Supreme Court to issue its decision by Friday. If it cannot meet this deadline, the party has asked for the disputed ballots to be counted separately.
