On Aug. 26, officers from the West Virginia State Police’s Tucker County detachment responded to assist CPS workers with a possible sexual assault, according to the criminal complaint.

The suspect, 38-year-old Timothy Sipolt of Independence, and the alleged victims (a 2-year-old and a 4-year-old child) were not home at the time, according to the complaint. But later that evening, troopers helped CPS remove the two victims from the residence.

Officers learned the sexual assault charges stemmed from “an incident that occurred last month,” and the victims were interviewed by the Children’s Advocacy Center on Aug. 28, according to the complaint.

Sypolt is accused of sexual assault in the first degree. He was booked into the Tygart Valley Regional Jail on Saturday, October 26, and remains there at press time.
