The transgender doctor was the “aggressor and bully” in a row with a nurse because of use for women only, the tribunal said.

Sandy Peggy nurse, who worked at Kirkaldi Hospital for 30 years, took NHS Fife and Dr. Beth Apton to the tribunal after the incident on the eve of 2023.

After suspending the accusation of bullying and harassment, she filed a complaint against the three cases that occurred in the locker room.

Yesterday, the tribunal was said that the 50 -year -old Mrs. Peggy actually fell victim to Dr. Apton’s abuse.

The decision to suspend Ms. Peggy after 29-year-old Dr. Apton charged on January 3, 2024, was also described as “ridiculous” due to the lack of evidence of any offenses.

There was also a “misunderstanding” between NHS staff about Ms. Peggy, which leads to “speculation” that the nurse can cruelly handle transgender people.

The NHS manager also said that she was told the problem by asking Dr. Apton in one room for accommodation is “not option”.

Mrs. Peggy’s lawyer Naomi Cunningham said, “Aggressor and bully – Beth Upton. The victim of this bullying is Sandy Peggy.

“The return of the victim and the defender is what happened here, with the full support of the NHS board.”

Ms. Peggy Line Manager Esther Davidson said in Danda that the decision to suspend Ms. Peggy is to protect Sandy, Beth and patients, but she confirmed that the nurse did not report two accusations of patient safety at the meeting.

On March 28, 2024, the tribunal heard Ms. Peggy became aware of the accusations of patient safety – however, her line leader stated that he “did not know the exact date” of the incident when Ms. Peggy allegedly left a cabin per unit of resuscitation when Dr -Pontone entered.

Emails from the NHS Fife personnel department read Ms Kanningham, who questioned the validity of patients’ safety problems due to the lack of evidence.

The tribunal heard the accusations based on “perception” and misunderstanding of problems that arise.

One email from the staff of Melanie Jorgensen said, “I agree with the advice where he is at risk. Do we have any evidence that confirm this problem?”

Another email from the same staff worker added: “I assume that the issue of patient safety concerns patients undergoing a similar process.”

Ms Kanningham said, “If the statement seems to have nothing in it, you do not necessarily launch an official investigation.

“Melanie Jorgensen is doing everything possible to understand what patient safety is.

“She seems to think that trans-identifying patients can be in some ways violently handled with the plaintiff.”

Giving testimony, Ms. Davidon said, “The accusations were about when Beth was in the booth with the patient, Sandy would go.”

The tribunal also heard the personnel worker described the fact that Mrs. Peggy spent the change at home, being stopped as “ridiculous”.

The e -mail of another staff worker in accordance with Ms. Yorgensen said, “I repeated that we have no evidence that she has left the patient, it will only be her perception (Dr. Upton).

“The nurse did not ask about it yet. For all years, the nurse has never had any problems.

“It was funny to have a nurse at home for two nights a week.”

Ms Kanningham said, “They believe that the only risk is that Sandy will face Beth in a locker room or other space.

“They are right, are they not that there were no previous worries about Sanda?

“The result of this conversation is that at this point was not confirmed at all. No confirmation has attracted your attention or refers to HR that Sandy leaves the cabin when Beth entered them. “

Ms. Davidon said, “There was no other person who would report it or no.”

E -letter from Dr. Apton’s line manager, Dr. Kate Sulfa, since December 30, stated that “she has convinced that Beth had no changes from Sandy by the end of January” that Ms Kanningham said it would “be” much less dramatic and economic option ‘.

The hearing is now postponed until July, and Ms. Peggy’s legal team intends to ask for a forensic examination of Dr. Apton’s phone, the tribunal is heard.

It will recover between July 16 and 30, and the application is submitted to the consultant Dr. Kate Sultus added as a respondent.
