The High Court agreed with the appellant that the offensive phrase cannot be considered casteist.

Any insult or intimidation of a person will not constitute an offense under the Act unless such insult or intimidation occurs because the victim belongs to a specified caste or a specified tribe,“, the court added.

From the case file, the court noted that the dispute arose out of a dispute over a car belonging to the applicant’s relative.

The court concluded that prima faciethe offense provided for by the Code of Administrative Offenses was not registered. However, there are other offenses according to the BNS prima facie attracted, expressed the opinion of the Court.

Noting that the other accused had already been released on bail, the court ultimately decided to grant the appellant early release on bail.

However, it was made clear that the Court’s observations in that judgment were made only for the purpose of deciding this appeal. The trial court should decide the case without any hindrance, the court said.
