A federal court dismissed a lawsuit against Sherwood for violating the civil rights of the arresting deputy

LITTLE ROCK, Arkansas. A lawsuit over the 2019 Sherwood arrest was dismissed in federal court Monday.

The lawsuit was filed on behalf of Robert Ward, who was arrested at his home on June 13, 2019, by three Sherwood police officers responding to a noise complaint. According to court records, he was charged with public intoxication, disorderly conduct and resisting arrest after a heated and heated exchange with SPD officers who responded to the complaint.

During the arrest, officers struggled with Ward as they wrestled him to the ground. Later, he said that he suffered a concussion and nerve damage as a result of the fall.

Ward was a Pulaski County sheriff’s deputy at the time. According to internal investigation documents, the PCSO eventually dismissed him for breaching the three codes of conduct that led to his arrest.

After his arrest, Mr. Ward filed suit against the officers and the city of Sherwood in federal court for the Eastern District of Arkansas, alleging malicious prosecution, illegal search and seizure, excessive force, and retaliatory arrest in violation of the First Amendment. All those charges were dismissed by District Judge Billy Roy Wilson, who said he thought the police acted reasonably.

Sherwood Mayor Mary Jo Gay-Townsell was pleased the lawsuit was dismissed.

“Any injury sustained while interacting with a police officer is unfortunate, including Mr. Ward’s injury,” Hay-Townsell said. “We appreciate Judge Wilson’s order confirming that the officers’ actions in this incident were reasonable.”

The trial, which has now been canceled, was scheduled to begin on November 5.
